The EcoBuddies™ website is owned and operated by EcoBuddies™ Interactive Ltd, a company registered in British Columbia, Canada. Please carefully read these terms and conditions before using this Massive Multiplayer Online Role Playing Game (MMORPG) website (the “Website). By selecting the I agree box, you are agreeing to these terms and conditions. Whether you create a user account or not, your using or accessing any part of this Website, or making any submissions, is based upon your fully accepting these Terms and Conditions. If you do not agree with these terms and conditions you may NOT use this Website. We reserve the right to unilaterally add, change, and modify these Terms and Conditions at any time. Once any such changes, additions, and modifications are posted, they take effect immediately. As a result, it is essential that each time you use this Website you review these Terms and Conditions. Your continued use of this Website is treated as your acceptance of any and all changes made to the terms and conditions, from the date on which they take effect, as shown above. Any question you have regarding these terms and conditions must be directed to termsandconditions@ecobuddies.com Only once you are satisfied with, and can accept these terms and conditions as they are and in their entirety, are you permitted to use this Website. There is absolutely no advertising on the EcoBuddies™ Interactive Ltd. Website. You may not promote or advertise any products or services on the Website.

Definitions

The words “Website”, “we”, “us”, “our” and “MMORPG”, all refer to the company EcoBuddies™ Interactive Ltd. and to the Company Website. The words “player”, “players”, “submitter”, “user”, “users”, “you” and “your” all refer to you, the individual who is creating an account or otherwise using our website. The word “submission” and “submissions” means both solicited and unsolicited, and covers any and all forms of communication and covers any and all types, categories, numbers, and kinds of submissions such as creative suggestions, materials, works, or ideas. The words “terminate” and “terminated” can mean temporary suspension, permanent suspension, account closure, or the banning of your computers’ access to our website.

Description of Services

In order to use the Website, you must supply all of the necessary equipment and must also provide for your own personal internet access, in order to connect to and use the Website. EcoBuddies™ Interactive Ltd. reserves the right to unilaterally, and without the need for the user’s consent, and without any notice or stated reason, terminate, delete, or suspend your account(s) and block your internet access to this Website. EcoBuddies™ Interactive Ltd. reserves the right to unilaterally change, modify, add or delete any and all portions of the Website, virtual items that may be purchased or that have already been purchased by any user, at any time. EcoBuddies™ Interactive Ltd. does not guarantee that the Website will be accessible on the World Wide Web (the Internet). Telecommunication disruptions, application failure, hardware failure, and any other act of God may happen at any time, thereby disrupting access to the Website. We do not endorse or guarantee the accuracy or truthfulness of any communication between players and therefore EcoBuddies™ Interactive Ltd. along with the owners, executives, directors, officers, employees and contractors disclaim any and all liability. Any communication between users through the chat function, or through the mail function must be vetted by individual users.

License to Use the Website

Both paying and non-paying users of the website are only granted a license to use the website and there is no explicit or implicit right to any virtual property in the game. EcoBuddies™ Interactive Ltd. ultimately owns all avatars, costumes, furniture, houses, vehicles, pets, and any and all other virtual items which a player may decide purchase, using their virtual coins. You must create a user account to access and play the Game. EcoBuddies™ grants all valid and up to day account holders a non-exclusive, non-transferable, limited, revocable user license, by which you can use this Website for your personal entertainment, education, communication, and information, in accordance to these terms and conditions. If you elect to become a paying member, you are responsible for paying for your membership, as required and as set out in the “becoming a paying member” page. The paying membership detail found on “becoming a paying member” form part of these terms and conditions, and need to be read by CLICKING HERE. Your user names must be appropriate. EcoBuddies™ Interactive Ltd. reserves the right to unilaterally terminate you account or change your user name if you use language that promotes illegal activity, is obscene, derogatory, hurtful, racist, harassing, abusive, threatening, sexually explicit, offensive, unlawful, prejudice, foul, bullying, or is otherwise deemed inappropriate. In addition, your username must not infringe on third party rights, be misleading, confusing, or impersonate EcoBuddies ™ Interactive Ltd. staff. You are responsible for how your account it used, who uses your account, and for keeping your password a secret. EcoBuddies ™ Interactive Ltd. staff will NEVER ask you for your password. Never give out your password. If you believe that someone is using your account, please change your password, in the “manage your account” section of the Website. The Website is to be used “as is” and we do not warranty or guarantee Website accessibility, that problems with the Website or with your user account will be fixed or solved, that our Servers are free from harmful mechanisms such as viruses, or that any content such as personal and credit card information you submit to any third party financial institutions, which you access through our website, will be used appropriately. There are no circumstances under which EcoBuddies™ Interactive Ltd offers an expressed or implied warranty or guarantee. By agreeing to these terms and conditions, you irrevocably waive any claim against EcoBuddies™ Interactive Ltd., along with the owners, executives, directors, officers, employees and contractors.

Use of Website Materials and Content

All material, content, function, code and submissions including but not limited to data, images, graphics, text, button icons, register and unregistered trademarks, illustrations, audio clips, sound, pictures, software, videos, animation, games, code, or other formats and forms that are found on this Website are trademarked and copyright protected. Any unauthorized use, reproduction, distribution, transmission, sale, or any other form of exploitation of the Website’s trademarked and copyrighted property is strictly prohibited. Any exception to this must be contained within the constraints of the applicable law, or be obtained from us in writing. For further inquiry please send an email to legal@ecobuddies.com The coins that are collected by using this Website do not constitute legal tender and have no value other than nominal value, and are not transferable. EcoBuddies™ Interactive Ltd. reserves the right to add or subtract coins from any user’s account without the need for the user’s consent, and without any notice or stated reason. We reserve the right to change, add, delete or modify any and all material, content, function, code, and submissions whenever, and to whatever extent we unilaterally decide.

Submissions

By submitting any submissions (as defined above) which include creative suggestions, materials, works, ideas or anything and everything else, you grant us moral rights and exclusive, unending, royalty-free, fully-paid worldwide license to use the submissions in every way, every format, every media, every place, every location, at any time, through the universe in perpetuity. By making a submission, you are claiming that the submission is your work, and not the copyrighted, trademarked, or otherwise protected work of someone else. No third party can claim any rights to ownership or compensation, and any and every other possible right through you, the submitter. Any submissions (as defined above) that you make are not done so in confidence, privacy, or trust and there is no fiduciary obligation created, established, or intended. The use of our Website, our servers, our games, and the possibility of having your submissions publicly displayed or otherwise used is hereby accepted by you as good and valuable consideration (the receipt and sufficiency of which is hereby acknowledged by accepting these terms). You have no right or expectation of any further consideration in any form (unless otherwise stated). We DO NOT accept any unsolicited submissions.

The reason we do not accept any unsolicited submissions is in order to prevent future misunderstandings regarding unsolicited creative suggestions, materials, ideas, or anything and everything else. Our Website’s designers, programmers, artists, animators, and all other staff work independently. By refusing to accept any un-solicited submissions, we are avoiding any chance that you may think that we have used your submissions, and that you are thereby entitled to some form of compensation.

Intellectual Property Rights

You are NOT permitted to hack into the Website, make derivative works, attempt to or decompile, reverse engineer, disassemble, modify, or use the code in any way, shape, or form, or for any purpose whatsoever. You may NOT reproduce, copy, distribute, sell, or otherwise use any of the Website’s images, sounds, games, content, or code. EcoBuddies ™ Interactive ltd. may at its sole discretion decide to take legal action, should such action be required to protect copyright, patent, trademark property, or to prevent what we unilaterally deem to be malicious Website use.

Personal Information

The only personal information that we store is the provinces, states or countries of a user, user gender, and the year in which the user was born, user names, passwords, and parents’ email address. DO NOT send us any other personal information, because there is no need to do so, and any other personal information will be immediately destroyed. Players CANNOT use their personal names as user names. If you forget your password, we will email you a password reminder to your parents email address that you provided us with when you originally created your account. EcoBuddies™ Interactive Ltd. does NOT store or keep a record of any payment information or billing information, in any capacity, or in any location including the Websites facilities, or on any of the Website’s servers. Any payment information including credit card information and billing information you provide is stored on secure, third party financial institution servers. Advanced encryption technologies (234 bit encryption?) along with secure servers are used by third party financial institutions to store your payment information.

Safety

Before using the Website, please read the SAFETY GUIDELINES, and PARENT INFORMATION. This Website has clear user guidelines, live moderators, and has a language filter installed. If you use language that promotes illegal activity, is obscene, derogatory, hurtful, racist, harassing, abusive, threatening, sexually explicit, offensive, unlawful, prejudice, fowl, bullying, or is otherwise deemed inappropriate your account will be terminated (as defined above), as EcoBuddies™ Interactive Ltd. unilaterally decides. We cannot and do not guarantee that all users will follow these terms and conditions, the user guidelines, and comply with the rules or any other provisions contained within this Website and that we will be able to catch and ban those who do not use the Website appropriately. If you find that you have been insulted, bullied, harassed, have identified potentially inappropriate behavior, or in any other way feel uncomfortable, you can contact moderator@ecobuddies.com to identify the user. In addition, when appropriate, you should seek help from parents, teachers, guardians, or local law enforcement authorities. You assume all risk of injury or harm resulting from others who breach the terms and conditions, the user guidelines, and who do not comply with the rule or with the other provisions contained within this Website. If you still find that using the Website is problematic or not satisfactory, you must immediately stop using the Website. You can use the Website’s built-in facilities to block messages from other players, should you decide to end unwanted, inappropriate, or offensive communications. In addition, you can report inappropriate behavior to us by clicking on the “moderator” button and sending us a message, which is visible and available in all interactive areas, to all players. If EcoBuddies™ Interactive Ltd. believes that there has been a breach of the terms and conditions or if there are any other breaches which may cause damage or harm to the Website, to other users, or to the world at large, we reserve the right to unilaterally terminate (as defined above) any user account(s) which may be involved, and block user access to our Website. Also, any further steps that we see as reasonable may be taken by EcoBuddies™ Interactive Ltd. in our efforts to ensure compliance to these terms and conditions.

All instructions (LINK), codes of conduct (LINK), guidelines (LINK) found on this Website along with the following general rules must be read and agreed to, as they all form part of these Terms and Conditions. The following are the general rules which state that you MUST NOT:

Subscriptions

This Website has a subscription component, in which a user can choose to become a paying member. If you decide to become a paying member, you guarantee that any and all information you submit such as your credit card information is in fact accurate and true. Where applicable, you must also obtain the proper parental or guardian consent. Applicable taxes are included in the price of memberships (ARE THEY?). All financial transactions are made in US dollars. All fees are paid in advance of receiving the benefits of being a paying member. EcoBuddies™ Interactive Ltd. reserves the right to increase or decrease the subscription fees. If we make a change, a notification will be sent to said parents’ email address. At that point, you can choose to agree to the fee increase, or if you disagree, you can cancel your subscription. It is important to check your junk email folder as your personal email address may not be set to accept our email. 30 days after we send out the email, any price changes will take effect. If you have not canceled your subscription in 30 days from when the email was first sent out, price changes will then take effect, and you will be billed accordingly. Cancellation

At any time you may cancel your subscription. You can CLICK HERE to do it now, or you can select the “cancel my membership” link on the Website. Once you have canceled you membership you will no longer be charged the subscription charge. There are no refunds, in whole or in part. However you are free to use the rest of the pre-paid time left on your account, as any payment you will have made is for a certain pre-determined period of time.

Disclaimer

YOU AGREE TO USE THIS WEBSITE ENTIRELY AT YOUR OWN RISK. YOU AGREE TO HOLD HARMLESS ALL OWNERS, EXECUTIVES, DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS FROM ANY AND ALL DAMAGES, LIABILITY, AND LOSSES ASSOCIATED WITH USING THE WEBSITE. YOU AGREE THAT ANY AND ALL LEGAL ACTION MUST BE FILED IN, AND TAKE PLACE IN THE COURTS OF VANCOUVER, BRITISH COLUMBIA, CANADA. YOU FURTHER AGREE THAT ANY CLAIM REGARDING A CAUSE OF ACTION MUST BE STARTED WITHIN 6 MONTHS AFTER THE CAUSE OF ACTION HAPPENED. AFTER THE 6 MONTH PERIOD HAS PASSED, ANY AND ALL CAUSE OF ACTION SHALL BE FOREVER EXCLUDED. ALL USERS OF THIS WEBSITE ARE RESPONSIBLE FOR OBEYING AND FOLLOWING THE LOCAL AREA LAWS IN WHICH THEY LIVE, OR IN WHICH THEY USE THE WEBSITE THAT PERTAIN TO THE USE OF THIS WEBSITE.
